2020 SSI Administrative Fines

The administrative fines of employers, who violate the provisions of the Social Insurance and General Health Insurance Law No. 5510, are clarified with the announcement of the Minimum Wage in 2020. You can review the table for the figures for the SSI Administrative Fines 2020.

For the ones who do not give the insured recruitment declaration and GSS entry declaration in accordance with the form and method determined by the Institution – the fee is equivalent to monthly minimum wage amount for each insured (*)2,943
In case the fact that the employment declaration for the insured is not given is understood from the court decision or the determinations made by the officers in charge of supervision and control or by the supervisors of other public administrations or from the information and documents obtained from banks, revolving funds, public administrations and institutions and organizations established by law – each insured is fined twice the monthly minimum wage 5,886
It is understood that the declaration of the recruitment of the insured is not made from the court decision for the second time in a year or from the determinations made by the Agency’s supervisory and control officers, or the supervisors of other public administrations, or from the information and documents received from the institutions and organizations established by law – the fine is determined as five times the monthly minimum wage for each insured14,715
For those who do not submit their workplace declaration in accordance with the form and method determined by the Institution within their legal period: 
For public administrations and those who have to keep books on a balance sheet basis (*) – three times the monthly minimum wage 8,829
For those who have to keep other books – twice the monthly minimum wage (*)5,886
For those who are not obliged to keep books – monthly minimum wage amount (*) 2,943
For each act, to those who do not submit their monthly premium and service documents within the period and form determined by the Institution: 
In case the document is original – the fee will be one fifth of the monthly minimum wage per insured number of employees registered in the document – to be capped by twice the monthly minimum wage588.60
In case the document is annexed – the fee will be one-eighth of the monthly minimum wage per number of insured registered in each additional document – not to exceed twice the monthly minimum wage 367.87
In case the supplementary document is not given within the period of the information and documents indicating that the insured is working for less than thirty days, or if the information and documents given are not officially valid by the Institution – the amount of half the minimum monthly wage per registered in each supplementary document – not to exceed twice the monthly minimum wage1,471.50
The court’s decision of the document, the services or earnings from the information and documents received from the banks, revolving funds, public administrations and institutions and organizations established by law as a result of the determinations made by the officers assigned by the Agency’s inspection and control, or the investigations, audits and investigations made by the supervisors of other public administrations. If the above is related to insured persons who are understood to have not been notified or underreported to the institution, the employer is fined twice the monthly minimum wage, regardless of whether the document is of original or additional nature, or whether it is issued to the employer5,886
For each month in which the amount of missing workmanship determined to be not reported to the Institution, based on the reports issued by the audit and control officers, who are authorized to review books and documents or by the SMMM and YMM – the fine is twice the monthly minimum wage 5,886
In the event that the workplace books, records and documents are not submitted in full within 15 days without force majeure or the books are not approved, despite the written notice made by the Institution,
to be examined by the inspection and control officers of the Institution:

For those who are obliged to keep books on a balance sheet basis –  the fine is twelve times the monthly minimum wage35,316
For those who are responsible for keeping other books – the fine is six times the monthly minimum wage 17,658
For those who are not obliged to keep books – the fine is three times the monthly minimum wage8,829
While submitting all of the books and documents within the given time, in case the registry records are deemed invalid,
for each calendar month in which the invalid cases occur: 

For those who are obliged to keep books on a balance sheet basis – the fine is equal to half of the minimum wage, not to exceed twelve times the minimum wage1,471.50
For those who are obliged to keep other books – the fee is half the minimum wage, not to exceed six times the minimum wage1,471.50
For those who are not obliged to keep books – the fee is half of the minimum monthly wage, not to exceed three times the minimum wage1,471.50
While a book should be kept on a balance sheet basis, if a book is kept on an operation account basis, the fine is  twelve times the monthly minimum wage35,316
For each payment payroll deemed invalid – the fine is half of the monthly minimum wage1,471.50
Without the administrative penalty for invalid acts in terms of books and documents submitted for examination after the submission period and all or part of which is determined to be invalid:
For those who are obliged to keep books on a balance sheet basis – the fine is twelve times the monthly minimum wage35,316
For those liable to keep other books – the fine is six times the monthly minimum wage17,658
For those who are not obliged to keep books – the fine is three times the monthly minimum wage 8,829
For public administrations, revolving funds, institutions established by law and banks and banks, which do not provide the information and documents to be requested by the Institution regarding the minimum workmanship within a month at the latest – the fine is twice the monthly minimum wage5,886
Institutions and organizations and legal entities that did not submit to the Institution by arranging a declaration of insured employment for the insured under the scope of 4 / b (Bağ-Kur) – the fine is equivalent to the monthly minimum wage (*)2,943
Organizations and tax offices that have not notified the 4 / b insurers who reported that their activities have expired – the fine is equivalent to the monthly minimum wage (*)2,943
To the public administrations that did not report the incident causing duty disability to the Institution within the period – the fine is equivalent to the monthly minimum wage (*)2,943
Those who undertake all kinds of works done by tender and public administrations that do not notify the Institution of their addresses within the deadline, and companies with revolving funds and institutions under the Banking Law No. 5411, institutions and organizations established by law – the fine is equivalent to the monthly minimum wage (*)2,943
In the transactions to be determined by the Institution, public administrations and banks that do not inform/report the Institution about the uninsured persons whom they process – the fine is one-tenth of the monthly minimum wage per uninsured person  (*) 294.30
For the trade registry officers who fail to report the number of the insured and the date of their employment at the stage of establishment of the company to the Authority of the Trade Registry Officers – the fine is equivalent to the monthly minimum wage for each notification obligation (*)2,943
For the governorships, municipalities and other public and private legal entities who do not notify the Institution regarding documents related to the building licenses and all other licenses or license transactions and the employment related information within the period – the fine is equivalent to the monthly minimum wage (*)

Employers, insurers, business owners and other persons involved in the audit who prevent control officers in charge of investigating and auditing based on the Law no. 5510  – the fine is five times the monthly minimum wage14,715
Employers, insurers, business owners and other persons involved in the audit who prevent control officers in charge of investigating and auditing by threat and force – the fine is ten times the monthly minimum wage29,430
Within the scope of Article 100 of the SS and GSS Law numbered 5510, the public administrations, banks, institutions with revolving funds, institutions and organizations established by law, and other real and legal persons established by law, who do not submit the information and documents requested by the Institution  – the fine is five times the monthly minimum wage14,715
About the public administrations, banks, revolving institutions, institutions established by law and other real and legal persons, which provide the information and documents required by the Institution late within the scope of Article 100 of SS and GSS Law No. 5510 – the fine is twice the monthly minimum wage5,886
In cases of temporary disability allowance payments to insurance holders under 4 / a according to Article 100, the notifications requested by the employers by the Institution are not made within the specified time and electronically – the fine is one-tenth of the minimum wage per insured294.30
In the event that the notifications requested by the employers are not made at all by the Institution pursuant to Article 100 in the payment of temporary incapacity allowance for the insured under the scope of 4 / a – the fine is half the minimum wage per insured1,471,5
Those who fail to notify the termination of insurance under the scope of 4 / a and to the ballot boxes included in the provisional article 20 of the Law No. 506,  including notification regarding the start or end of ballot box participation within the period or in accordance with the form and method determined by the Institution or by the Institution on the internet, electronic or similar medium – the fine is one-tenth of the monthly minimum wage for each insured or ballot box participant, provided that they do not exceed the penalty amount due to not submitting the books and documents that are obliged to be submitted due to these acts committed in a calendar month (*)294.30
According to the sixth paragraph of Article 100 of the SS and GSS Law No. 5510, those who do not enter the information about the persons they are obliged to take care of, and those who do not enter the information that they are obliged to look after – – the fine is half the minimum wage1,471.50
In the event that the notification or control obligation to be made according to the annexed Article 6 of the SS and GSS Law numbered 5510 is not fulfilled – the fine for each act is equivalent of the monthly minimum wage 2,943
n) (Annex: 15/7 / 2016-6728 / 51 art.) In the Withholding Tax Return and Social Security Declaration, the name and code of the profession should be appropriate to the actual work done by the insured in the workplace. For those who fail to report correctly are fined one-tenth of the minimum wage per the insured reported incorrectly – not to exceed the monthly minimum wage for each workplace 294.30
(*) If the penalties are paid within 30 days after the legal period of the declaration or document and the penalties are paid within 15 days from the day following the date of notification, the envisaged penalties will be applied by a quarter. Exceptions include: the legal decision of the declaration or document to the court decision, based on the investigations, inspections and inspections to be carried out by the inspectors of the other public administrations or the documents taken from the public administrations.
