Amendment on Permanent Work Permits

amendment-on-permanent-work-permitsAs is known there are various types of working permissions set out in  Law on the Work Permit for Foreigners, No. 4817. One of them is working permission for an indefinite period of time, and that may also be called “permanent work permit”.

Law No. 4817, Article 6 which is titled “Working permission for an indefinite period of time” and stipulates the requirements for entitlement of permanent work permit is amended by Article 22 of Act No. 6552, Law on Amending the Labor Act and Some Laws and Statutory Decrees and Restructuring Some Receivables, also known as Bag Law. New wording of said Article 6 after amendment is as follows:

“ARTICLE 6 – Unless otherwise provided in the bilateral or multilateral agreements to which Turkey is a party, and without prejudice to acquired rights of foreigners who are granted  working permission for an indefinite period of time before April 11.2014; holders of a long-term residence per­mit pursuant to Law on Foreigners and International Protection, No. 6458, or those foreigners that have resided in Turkey uninterruptedly for at least eight years with a resident permit, or that have legally worked for total eight years may be granted working permission for an indefinite period of time.
Foreigners holding a working permission for an indefinite period of time shall benefit from the same rights long-term residence permit provides, which are set out in Law No. 6458, Article 44.

Working permission for an indefinite period of time shall be cancelled upon foreigner’s or his/her employer’s claim or in the cases specified in Law No. 6458, Article 45 that stipulates the circumstances under which long-term residence permit shall  be cancelled.
The records of entering into, staying in and exiting from turkey as regard to foreigners who are granted working permission shall be reported to the Ministry, by Ministry of Interior.”

Qualifying For Permanent Work Permit

If there is no contradictory provision in the bilateral or multilateral agreements, and reserving the acquired rights before April 11.2014, foreigners who satisfy the below conditions may be given “permanent work permit;

  • having a long-term residence per­mit as per Law on Foreigners and International Protection, No. 6458,
  • having being residing in Turkey uninterruptedly for at least eight years with a resident permit,
  • having being legally working for total eight years.

Exemption From The Fee for Residence Permit

By the Article 23 of above mentioned Bag Law, the subparagraph (h) is added to Article 88 of Law on Fees, No. 492, and in accordance with this subparagraph holders of permanent work permit do not pay any fee for their residence permits.
