What are the requirements in order to be entitled to unemployment pay? Based on clause 24 of labor law no. 4857, if the wage is not paid as indicated by the law and the employment contract, the employee can terminate the employment contract by just cause and be entitled to severance pay without the need to wait for the following 20 days. The employee would need to prove that he/she wasn’t paid as previously agreed. If an employee terminates contract by just cause, he/she will be entitled to unemployment pay.

According to Unemployment Insurance Law no. 4447; one is entitled to unemployment pay if the employee;

–    performed with the will to work, good health, talent and efficiency and lost his job without his/her own will and any fault committed.
–    had filed unemployment application within the 30 day upon the termination of employment;
–    had worked and paid the last 120 days of unemployment insurance premium besides having paid 600 days of unemployment insurance premium within the last 3 years.
