Conditions of Shift Work and Night Work

In case the work, due to its nature, has to be carried on continuously employees can be engaged successive or rotating shifts.

Labor Law 4857 and related regulations stipulates some restrictions on night working.

Female Employees 

According to “Regulation on Working Conditions of Women at Nightshift;” 

Female employees must not be engaged at night shifts exceeding seven and a half hours. However, in the workplaces operating in the field of tourism, private security and health services employees may work over 7,5 hours provided that employees’ written consent is obtained.

As a matter of fact above restriction is valid for all employees as per Labor Law 4857, amended article 69;

“Night work for employees must not exceed seven and a half hours. However, in the workplaces operating in the field of tourism, private security and health services employees may work over 7,5 hours provided that employees’ written consent is obtained”.

Special conditions at night shifts

Also, “Regulation on Special Principles and Procedures for the Employees Working at nightshift allows for working at night shifts up to 11 hours in the fields specified above.

In these sectors work can be done in two shifts (daytime or night shifts) instead of three.

In case more than half of the work is done in at nights, work is deemed night work.

Employees are under the obligation of keeping records of employees engaged at shift work. The records shall be submitted in case required by the Ministry.

Children and young employees

As per Labor Law, article 73; children and young employees under the age of eighteen must not be employed on industrial work during the night.
