Revisions on the Work Permits for Foreigners

yabancilarin-calisma-izinlerinde-degisiklik As is known, detailed regulations on the work of foreigners in Turkey are included in Application Regulations of Law On The Work Permit For Foreigners which is published in the Official Gazette no. 25214 dated 29/8/2003.

The amendments made to Article 55 of Application Regulations of Law On The Work Permit For Foreigners which is published in the Official Gazette  no. 25214  dated 29/8/2003 are as follows;

  • the phrase, “without exceeding three months from the date of their entering into Turkey” present in items (c) and (ç) of first paragraph is amended as ” without exceeding three months within a year from the date of their entering into Turkey”,
  • the phrase, “(c) and (ç)” present in third paragraph is repealed,
  • the following paragraph has been added as paragraph (4), arranged as to come after third paragraph and the oncoming paragraph shall continue accordingly (the present paragraph (4) shall be continued as paragraph (5),
  • “(4) Foreigners in the scope of  items (c) and (ç) of first paragraph, on condition that their in-country period not exceeding three months within a year from the date of entry shall be provided multiple entry.

Favorable Revisions for Foreigners

The above mentioned revisions should obviously be interpreted as favorable for foreign professionals of some occupational groups depending upon their in-country period not subject to a work permit. This is because:

According to first paragraph of Article 55 of aforesaid Regulation’s items before amendment;

c) Foreigners arriving for the purpose of assembly, maintenance and repair of machinery and equipment imported, and providing training on use of them or for the purpose of taking the delivery of equipment or of repairing the malfunctioned tools in Turkey,  provided that they documented their mentioned assignment, without exceeding three months from the date of their entering into Turkey,

ç) Foreigners arriving for the purpose of providing training on use of exported and imported goods and services, provided that they documented their mentioned assignment, without exceeding three months from the date of their entering into Turkey were not subject to a work permit.
And according to third paragraph of Article 55, before repeal, foreigners within the scope of items (c) and (ç) of first paragraph of Article 55 used to benefit from these exemption only once in a calendar year. In other words, regardless of their in-country periods foreigners entering Turkey more than once in a year were subjected to work permit.

But after the revisions, as also stipulated in added paragraph (4),  professionals of above mentioned occupational groups may enter into or go out of country as many times needed without a work permit on the condition that their in-country period not exceeding three months within a year from the date of entry.

As this Regulations has been entered into force from the date of its publication, above mentioned foreigners are entitled to multiple entry without needing a work permit on the said conditions as of the date of 22 January 2015.
