Privacy Notice Under Turkish Personal Data Protection Law No. 6698
In its capacity as data controller, iskanunu.com (“iskanunu”) provides this Privacy Notice to data subjects before processing the personal data it obtains, in order to fulfil its duty to inform under Article 10 of Turkish Personal Data Protection Law No. 6698 (the “KVKK”) and in accordance with the Communiqué on the Procedures and Principles to Be Followed in Fulfilment of the Obligation to Inform issued by the Turkish Personal Data Protection Authority.
1. Definitions
Explicit Consent: A freely given, informed and affirmative declaration of consent relating to a specific matter.
Personal Data: Any information relating to an identified or identifiable natural person.
Special Categories of Personal Data: Data relating to a person’s race, ethnic origin, political opinion, philosophical belief, religion, religious sect or other belief, appearance and clothing, membership of an association, foundation or trade union, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data.
Processing of Personal Data: Any operation performed on Personal Data, including the collection, recording, storage, retention, alteration, reorganisation, disclosure, transfer, acquisition, making available, classification or restriction of use of such data, whether performed wholly or partly by automated means or by non-automated means where the processing forms part of a data filing system.
Data Controller: The natural or legal person who determines the purposes and means of processing Personal Data and is responsible for establishing and managing the data filing system.
Data Filing System: A filing system in which Personal Data are processed according to specific criteria.
Data Subject: The natural person whose Personal Data are processed.
2. Purposes of Processing Personal Data
iskanunu collects and processes your Personal Data for the following purposes:
- Providing, developing and improving our website services
- Analysing website visitors and maintaining archives
- Providing commenting and question-submission services
- Sending newsletters and information where requested
- Communicating through any available channel
- Making copies and backups to prevent data loss
- Ensuring compliance with legal obligations, rights and responsibilities as required or mandated by applicable laws and regulations
- Fulfilling data-retention, reporting and disclosure obligations imposed by judicial and administrative authorities
- Other purposes specified in the KVKK
3. Recipients to Whom Personal Data May Be Transferred
For the purposes stated above, Personal Data shared by Data Subjects with iskanunu may be transferred to the group companies with which iskanunu is affiliated, service providers that supply website analytics services (such as Google Analytics), and competent public authorities and institutions where necessary to comply with legal obligations.
Personal Data provided by you will not be used for purposes other than those set out above or otherwise shared with third parties.
4. Methods and Legal Bases for Collecting Personal Data
Your Personal Data are collected in writing or electronically, including through our website.
Once the Data Subject has been informed in accordance with applicable legislation and this Notice, Personal Data will be processed after the Data Subject has freely given explicit consent in writing or electronically to the collection and/or processing of such data. Personal Data may be processed without the Data Subject’s consent where any of the following conditions specified in the KVKK applies:
- Processing is expressly provided for by law.
- Processing is necessary to protect the life or physical integrity of the Data Subject or another person where the Data Subject is physically or legally incapable of giving consent.
- Processing Personal Data relating to the parties to a contract is necessary, provided that it is directly related to the establishment or performance of that contract.
- Processing is necessary for the Data Controller to comply with a legal obligation.
- The Personal Data have been made public by the Data Subject.
- Processing is necessary for the establishment, exercise or protection of a right.
- Processing is necessary for the legitimate interests of the Data Controller, provided that it does not prejudice the fundamental rights and freedoms of the Data Subject.
Special Categories of Personal Data may be processed only with the Data Subject’s explicit consent or where processing is expressly permitted by law. When processing Special Categories of Personal Data, iskanunu acts in accordance with the decisions of the Turkish Personal Data Protection Board.
5. Rights of the Data Subject
Natural persons whose Personal Data are collected or processed by iskanunu have the right to apply to the Data Controller under the KVKK.
To exercise these rights, the Data Subject may submit any of the following requests to iskanunu in writing or by email using the contact details set out in Section 6 below:
a. To learn whether their Personal Data are being processed;
b. If their Personal Data have been processed, to request information concerning such processing;
c. To learn the purpose for which their Personal Data are processed and whether they are used in accordance with that purpose;
d. To be informed of the third parties in Türkiye or abroad to whom their Personal Data have been transferred;
e. To request the rectification of Personal Data that have been processed incompletely or inaccurately;
f. To request the deletion or destruction of Personal Data in accordance with the KVKK;
g. To request that the actions taken pursuant to paragraphs (e) and (f) above be notified to third parties to whom their Personal Data have been transferred;
h. To object to any outcome detrimental to the Data Subject resulting from the analysis of processed Personal Data exclusively by automated means; and
i. To claim compensation for any loss or damage suffered as a result of the unlawful processing of Personal Data.
